     18 Our first information about the new Wassenaar Arrangement came in the
     19 form of a newspaper article, which said that export of encryption
     20 software would be prohibited&mdash;and this seemed to include free
     21 software.  So we posted an announcement seeking people in
     22 non-Wassenaar countries to participate in distribution and development
     23 of free software for encryption.</p>
     24 
     25 <p>
     26 Subsequently the actual text of the new version of Wassenaar Arrangement was
     27 published.  Then we saw that it continues to have an exception that
     28 seems to cover free software.  (They use the term &ldquo;public
     29 domain,&rdquo; but they seem to mean something like free software by
     30 that.)  So the problem seems to have been a false alarm.</p>
     31

     33 However, the US continues to seek such restrictions, and therefore it
     34 makes sense to continue our preparations, as a precaution in case a
     35 future version of the Wassenaar Arrangement places further restrictions
     36 on exportation of free software.</p>

     39 Here is our interpretation of the text of the latest Wassenaar
     40 Arrangement, as we have seen it.  This has not been checked by a
     41 lawyer.</p>
     42

     44 According to the General Software Notes, entry 2, the agreement does
     45 not cover software which is in &ldquo;the public domain.&rdquo; This
     46 is defined in the definitions as technology or software which has been
     47 made available without restrictions upon its further dissemination.
     48 There is also a statement that copyright by itself does not deny a
     49 program this &ldquo;public domain&rdquo; status.</p>
     50

     52 There are currently discussions about the agreement and it would seem
     53 logical that the definition of &ldquo;public domain&rdquo; is
     54 something that will be clarified at future meetings.</p>

     57 Finnish officials have stated that &ldquo;nothing will change as
     58 far as the &lsquo;public domain&rsquo; software and the Dec 3
     59 Wassenaar Arrangement are concerned.&rdquo;</p>

     62 In Denmark, we are told, there has been an incident where the Ministry
     63 of Commerce informed an administrator to stop offering the program PGP
     64 for download.</p>

     67 Recent news indicate that the Australian government has prohibited the
     68 export of free software for encryption by modifying the Wassenaar list
     69 that related to the definition of software &ldquo;in the public
     70 domain.&rdquo;</p>
