      6 Welcome! GNUnet e.V. (“we,” “our,” or “us”) provides a privacy-
      7 friendly Taler wallet key directory through our Internet presence
      8 (collectively the “Services”). Before using our Services, please read
      9 the Terms of Service (the “Terms” or the “Agreement”) carefully.

     15 This section provides a brief summary of the highlights of this
     16 Agreement. Please note that when you accept this Agreement, you are
     17 accepting all of the terms and conditions and not just this section.
     18 We and possibly other third parties provide Internet services which
     19 interact with the TalDir key directory application. When using an
     20 application to interact with our Services, you are agreeing to our
     21 Terms, so please read carefully.

     24 Highlights:

     27    * You are responsible for selecting authentication methods and
     28      policies that are adequate to protect your wallet key mappings.
     29      Any losses arising from you not being able to satisfy the
     30      selected authentication challenges or third parties being able
     31      successfully pass the challenges are your problem.

     33    * We will store your hashed account handle and allow clients to
     34      query the associated Taler wallet key material. Our liability
     35      will be limited to the liability limit exposed in the protocol.
     36 
     37    * For our Services, we may charge various fees. The specific fee
     38      structure is provided based on the TalDir protocol and should be
     39      shown to you when you use an application to interact with our
     40      services. You agree and understand that the TalDir protocol
     41      allows for the fee structure to change.

     43    * You agree to not intentionally overwhelm our systems with
     44      requests and follow responsible disclosure if you find security
     45      issues in our services.
     46 
     47    * We cannot be held accountable for our Services not being
     48      available due to circumstances beyond our control. If we modify
     49      or terminate our services, we will announce this and ensure that
     50      you can recover your key material for at least one year before we
     51      completely terminate the Service.

     54 questions or comments related to this Agreement, please send us a

     56 you must not use our Services.

     62 By using our API (typically via an TalDir-enabled application), you
     63 acknowledge that you have read, understood, and agreed to these Terms.
     64 We reserve the right to change these Terms at any time. If you
     65 disagree with the change, you must simply stop using our APIs.  Your
     66 continued use of our Services following any such change will signify
     67 your acceptance to be bound by the then current Terms. Please check
     68 the effective date above to determine if there have been any changes
     69 since you have last reviewed these Terms.

     75 We will store your hashed account handle and an associated Taler
     76 wallet key. To the best of our ability and within the limitations of
     77 the implementation. This mapping can be queried by third parties as
     78 that is the purpose of the service. We will rate-limit the use of the
     79 authentication APIs to limit brute-force attacks.

     81 We are not guaranteeing that the authentication procedures are
     82 effective. Other parties may be able to intercept authentication
     83 messages, or you may not be able to receive these messages anymore.
     84 You are responsible for choosing safe authentication methods with
     85 sufficient security.

     87 When using our Services, you agree to not take any action that
     88 intentionally imposes an unreasonable load on our infrastructure. If
     89 you find security problems in our Services, you agree to first report
     90 them to taldir@gnunet.org and grant us the right to publish your
     91 report. We warrant that we will ourselves publicly disclose any issues
     92 reported within 1 month, and that we will not prosecute anyone
     93 reporting security issues if they did not exploit the issue beyond a
     94 proof-of-concept, and followed the above responsible disclosure
     95 practice.

    101 You agree to pay the fees for initial registration and monthly service
    102 ("Fees") as defined by us, which we may change from time to time. Your
    103 TalDir client should obtain and display applicable fees during
    104 registration and renewal of registrations.

    110 To be eligible to use our Services, you must be able to form legally
    111 binding contracts or have the permission of your legal guardian. By
    112 using our Services, you represent and warrant that you meet all
    113 eligibility requirements that we outline in these Terms.

    116 Copyrights and trademarks

    119 The TalDir software is released under the terms of the GNU Affero
    120 General Public License (GNU AGPLv3+). You have the right to access,
    121 use, and share the TalDir application, in modified or unmodified form.
    122 However, the Affero GPL is a strong copyleft license, which means that
    123 any derivative works must be distributed under the same license terms
    124 as the original software. If you have any questions, you should review

    132 You understand and agree that we have no control over, and no duty to
    133 take any action regarding: Failures, disruptions, errors, or delays in
    134 processing that you may experience while using our Services; The risk
    135 of failure of hardware, software, and Internet connections; The risk
    136 of malicious software being introduced or found in the software
    137 underlying the TalDir implementation. You release us from all
    138 liability related to any losses, damages, or claims arising from:

    140 1. user error such as forgotten security answers or loss of control
    141    over accounts used for authentication;

    143 (b) server failure or data loss; (d) bugs or other errors in the
    144 TalDir client software; and (e) any unauthorized third party
    145 activities, including, but not limited to,

    147    the use of viruses, phishing, brute forcing, or other means of
    148    attack against the TalDir client. We make no representations
    149    concerning any Third Party Content contained in or accessed through
    150    our Services.

    152 Any other terms, conditions, warranties, or representations associated
    153 with such content, are solely between you and such organizations
    154 and/or individuals.

    156 To the fullest extent permitted by applicable law, in no event will we
    157 or any of our officers, directors, representatives, agents, servants,
    158 counsel, employees, consultants, lawyers, and other personnel
    159 authorized to act, acting, or purporting to act on our behalf
    160 (collectively the “TalDir Parties”) be liable to you under contract,
    161 tort, strict liability, negligence, or any other legal or equitable
    162 theory, for:

    165    goods or services, or direct, indirect, incidental, special,
    166    punitive, compensatory, or consequential damages of any kind
    167    whatsoever resulting from:

    171    2. any unauthorized use of your wallet and/or private key due to
    172       your failure to maintain the confidentiality of your wallet;

    174    3. any interruption or cessation of transmission to or from the

    177    4. any bugs, viruses, trojan horses, or the like that are found in
    178       the Taler Wallet software or that may be transmitted to or
    179       through our services by any third party (regardless of the
    180       source of origination), or

    185 tort, strict liability, breach of contract, breach of warranty, or any
    186 other legal theory, and whether or not we were advised of the

    189 damages, so the above limitation may not apply to you.

    209 Indemnity and Time limitation on claims and Termination

    216 arising from: (a) your use of and access to the Services; (b) any
    217 feedback or submissions you provide to us concerning the TalDir
    218 software; (c) your violation of any term of this Agreement; or (d)
    219 your violation of any law, rule, or regulation, or the rights of any
    220 third party.

    222 You agree that any claim you may have arising out of or related to
    223 your relationship with us must be filed within one year after such
    224 claim arises, otherwise, your claim in permanently barred.

    226 In the event of termination concerning your use of our Services, your
    227 obligations under this Agreement will still continue.

    230 Discontinuance of services and Force majeure

    233 We shall not be held liable for any delays, failure in performance, or

    235 cause or condition beyond our reasonable control, including but not
    236 limited to: any delay or failure due to any act of God, act of civil

    238 strike or other labor dispute, fire, interruption in
    239 telecommunications or Internet services or network provider services,
    240 failure of equipment and/or software, other catastrophe, or any other
    241 occurrence which is beyond our reasonable control and shall not affect
    242 the validity and enforceability of any remaining provisions.

    245 Governing law, Waivers, Severability and Assignment

    248 No matter where you’re located, the laws of Germany will govern these
    249 Terms. If any provisions of these Terms are inconsistent with any
    250 applicable law, those provisions will be superseded or modified only
    251 to the extent such provisions are inconsistent. The parties agree to
    252 submit to the ordinary courts in Germany for exclusive jurisdiction of
    253 any dispute arising out of or related to your use of the Services or
    254 your breach of these Terms.

    256 Our failure to exercise or delay in exercising any right, power, or
    257 privilege under this Agreement shall not operate as a waiver; nor
    258 shall any single or partial exercise of any right, power, or privilege
    259 preclude any other or further exercise thereof.

    261 You agree that we may assign any of our rights and/or transfer, sub-
    262 contract, or delegate any of our obligations under these Terms.

    264 If it turns out that any part of this Agreement is invalid, void, or
    265 for any reason unenforceable, that term will be deemed severable and
    266 limited or eliminated to the minimum extent necessary.

    268 This Agreement sets forth the entire understanding and agreement as to
    269 the subject matter hereof and supersedes any and all prior
    270 discussions, agreements, and understandings of any kind (including,
    271 without limitation, any prior versions of this Agreement) and every
    272 nature between us. Except as provided for above, any modification to
    273 this Agreement must be in writing and must be signed by both parties.
